Platform Use Agreement

1.1 Introduction

These Terms & Conditions ("Terms") govern the use of the AgriSat Technologies Ltd platform, including website, mobile applications, and all related services. By using the platform, you agree to be bound by these Terms.

1.2 Definitions

Platform: AgriSat Technologies digital ecosystem

User: Any farmer, buyer, partner, or visitor

Services: Marketplace, satellite insights, logistics, payments

1.3 Eligibility

Users must:

Be at least 18 years old
Provide accurate registration information
Comply with all applicable laws in Ghana

1.4 User Accounts

Users are responsible for account security
AgriSat may suspend or terminate accounts for violations
False information may lead to immediate termination

1.5 Platform Services

AgriSat provides:

Digital Marketplace

Satellite Monitoring

Logistics & Storage

Payment Facilitation

AgriSat reserves the right to modify services at any time.

1.6 Payments & Fees

Transactions may attract service fees or commissions
Payments are processed via third-party providers (e.g., MoMo, Paystack)
AgriSat is not liable for third-party payment failures

1.7 Acceptable Use

Users must NOT:

Engage in fraud or misrepresentation
Manipulate pricing or exploit farmers
Upload false or misleading data
Attempt to hack or disrupt the platform

1.8 Intellectual Property

All platform content, software, and data (excluding user-submitted data) are owned by AgriSat Technologies Ltd.

1.9 Limitation of Liability

AgriSat shall not be liable for:

Crop losses or farming outcomes
Market price fluctuations
Delays caused by logistics partners
Third-party service failures

1.10 Termination

AgriSat may suspend or terminate access for:

Breach of Terms
Fraudulent activity
Regulatory requirements

1.11 Dispute Resolution

1 Platform-mediated resolution

2 Arbitration under Ghana law

1.12 Governing Law

These Terms are governed by the laws of the Republic of Ghana.

This Agreement is between AgriSat Technologies Ltd (Data Controller) and Partner/Service Provider (Data Processor).

3.1 Purpose

Geospatial Data

Transactional Data

3.3 Processor Obligations

The Processor shall:

Process data only on documented instructions
Maintain confidentiality
Implement appropriate security measures
Not subcontract without approval

3.4 Data Security

Processor must implement:

Access Controls

Incident Response

3.5 Data Breach Notification

Notify AgriSat within 48 hours of any breach

3.6 Subprocessors

Must be approved by AgriSat
Must meet same data protection standards

3.7 Data Transfer

Cross-border transfers must:

Ensure adequate protection
Comply with applicable laws

3.8 Termination & Liability

Upon Termination:

Data must be returned or securely deleted

Processor Liability:

• Data misuse
• Security breaches due to negligence

4. Mobile App Privacy Addendum

For Android & iOS Applications

4.1 Scope

This Addendum applies specifically to AgriSat mobile applications (Android & iOS).

4.2 Additional Data Collected

Device Data

• Device ID
• Operating system
• App usage logs

Location Data

• GPS-based farm mapping
• Real-time tracking
• (with consent)

Media Data

• Photos uploaded
• Crop diagnosis
• Field images

4.3 Permissions Required

4.4 Push Notifications
